Details

Possession, delivery or sale of one-half ounce or less is punishable by up to one year in jail and a fine up to $2,500.

For delivery or sale of amounts over one-half ounce the penalty increases to 1 - 6 years in prison and a fine up to $5,000. Delivery or sale of 10 pounds or more is punishable by 2 - 12 years in prison and a fine up to $5,000. For amounts of 70 pounds or more, the penalty increases to 8 - 30 years in prison and a fine up to $200,000. Delivery or sale of 300 pounds or more carries a penalty of 15 - 60 years in prison and a fine up to $500,000.

Any sale to a minor or any sale within 1,000 feet of a school increases the penalty classification one level.

Cultivation of 10 - 19 plants is punishable by 2 - 12 years in prison and a fine up to $50,000. For cultivation of 20 - 99 plants, the penalty increases to 3 - 15 years in prison and a fine up to $100,000. For 100 - 499 plants the penalty increases to 8 - 30 years in prison and a fine up to $200,000. Cultivation of 500 or more plants is punishable by 15 - 60 years in prison and a fine up to $500,000.

For all first convictions for misdemeanor drug offenses there is a mandatory minimum fine of $250. For second convictions the mandatory minimum increases to $500 and for subsequent convictions, it increases to $1,000. For all fist convictions of felony drug offenses there is a mandatory minimum fine of $2,000, increasing to $3,000 for second convictions and to $5,000 for any subsequent convictions.

The use or possession of paraphernalia is punishable by up to one year in jail and a fine up to $2,500. Sale of paraphernalia carries a penalty of 1 - 6 years in prison and a fine up to $3,000.

Marijuana tax stamps: This state has a marijuana tax stamp law enacted. This law mandates that those who possess marijuana are legally required to purchase and affix state-issued stamps onto his or her contraband. Failure to do so may result in a fine and/or criminal sanction.
